Viruses etc.

I do not guarantee that my site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access my site. You should use your own virus protection software.

You must not misuse my site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to my site, the server on which my site is stored or any server, computer or database connected to my site. Freedom Works Kishorn

A shop, website and online marketplace especially for arts & crafts handmade by individuals living in the Scottish Highlands.

Terms and conditions for buying on the Freedom Works Kishorn website - these terms will apply as between Freedom Works Kishorn and those buying items via the website and shall apply unless otherwise agreed in writing.

  1. Who is Freedom Works Kishorn

In these terms, buyers are referred to as buyers, customers and you.

  1. What I do

Freedom Works Kishorn is a marketplace for original arts & crafts handmade by individuals living in the Scottish Highlands. I shall act as the central point of contact between buyers and sellers, accepting orders and payments from buyers on behalf of and as agent for sellers and dealing with all customer communications, enquiries and issues.

If you decide to buy any items via the site, your contract for that purchase is between you and the seller of that item and that contract shall comprise these terms, the email confirmation of your order and the details of the item shown on my site. These terms shall prevail in the event of any conflict or inconsistency.

I cannot give any undertaking that the goods you purchase from sellers through the site will be of satisfactory quality and this and any other such warranties are disclaimed by me to the fullest extent permitted by law. This disclaimer does not affect your statutory rights against the seller.

  1. How do I place an order?

You can place an order for any item displayed on the FWK website via the shop page. This is an offer to purchase. The order will be deemed to be accepted and the purchase contract formed between you and the seller when I (on behalf of and as agent for the seller) send you an email confirmation of that order. I would normally expect to issue that confirmation within 48 hours. If the order cannot be accepted for any reason, I will let you know by email.

I work with sellers to try and ensure that all listings are as accurate as possible but some items may vary slightly from their photographs.

  1. Payment

Payment for items ordered via the website may only be paid for using the payment methods I make available from time to time through my payment facility. I receive all payments as agent for the sellers and will deal with onward payments to the sellers or refunds to you as appropriate on their behalf.

Item listings will show the price of the item, options for delivery and any additional delivery charges which may apply.

If you order items for delivery outside the UK, they may be subject to import duties and taxes which are levied at the destination. You are responsible for any such charges. I am not able to confirm if any particular charges apply and you should check with your local customs office before placing an order.

  1. Delivery

I would normally expect items to arrive with buyers within 5-7 working days of the order being accepted. If the delivery timescale will be longer because an item is personalised or made-to-order or if there is a known delay, I will let you know either through the item listing or by email once you have placed an order. Neither I nor the sellers are responsible for delays beyond my control.

You should ensure that the delivery details which you provide when you place an order are accurate and any special arrangements are noted e.g. leave in safe place, with a neighbour so that the delivery can be completed.

6 Returns and cancellation

If you have changed your mind about an order or an item you have received, please let us know by email to [email protected]

You have 14 days from the day you that receive an item to notify FWK that you wish to return it and specify the reason why. I will then confirm the address to which the item should be returned. You then have a further 14 days to return the item - I recommend that you use a signed for service with proof of postage. Please note that you will bear the cost of returning the item.

I will refund you within 14 days of receiving confirmation of receipt of the returned item from the seller or if you cancelled your order before the item was sent to you, within 14 days of your email to us cancelling the order. The refund will cover the price you paid for the item but not postage costs unless the item is faulty.

The following items are not returnable - perishable items, items which are personalised or bespoke or made to specific requirements, items which cannot be returned for hygiene reasons.

I hope that all items arrive with you in perfect condition but if you do receive an item that is faulty, please email [email protected] with details and if possible, a photograph of the issue, so that I can try to resolve things as soon as possible.

  1. GDPR and Use of Information

Freedom Works Kishorn complies with the principles of the General Data Protection Regulations. My privacy policy sets out further details. I will provide your name and address to the relevant seller to allow them to fulfil your order.

  1. General

If any part of these terms shall be held to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these terms.

These terms are governed and construed in accordance with Scots law.

  • The following types of third parties - (a) sellers on my website so that when a customer places an order on my website, the seller can deliver that order (b) customers so that if an item is to be returned, the customer can send the item to the correct address, (c) payment providers in order that payments can be made on my website, I will share Financial Data with payment providers (d) social media platforms - I may make your name and email address available to companies to advertise and market my services through other platforms on the internet
  • Third parties to whom I may choose to sell, transfer or merge parts of my business or my assets. Alternatively, I may seek to acquire other businesses or merge with them. If a change happens to my business, then the new owners may use your personal data in the same way as set out in this privacy policy.

I require all third parties to respect the security of your personal data and to treat it in accordance with the law. I do not allow my third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with my instructions.

Some of my third parties in particular, some customers are based outside the EEA so their processing of seller personal data will involve a transfer of data outside the EEA. Whenever I transfer your personal data out of the EEA, I ensure a similar degree of protection is afforded to it by ensuring that I will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission. I have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, I limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on my instructions and they are subject to a duty of confidentiality.

I have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where I am legally required to do so.

I will only retain your personal data for as long as reasonably necessary to fulfil the purposes I collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. To determine the appropriate retention period for personal data, I consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which I process your personal data and whether I can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances I will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case I may use this information indefinitely without further notice to you.

Under certain circumstances, you have rights under data protection laws in relation to your personal data. Your rights are listed below.

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data I hold about you and to check that I am lawfully processing it.

Request correction of the personal data that I hold about you. This enables you to have any incomplete or inaccurate data I hold about you corrected, though I may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where I may have processed your information unlawfully or where I am required to erase your personal data to comply with local law. Note, however, that I may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Note that this right only applies to automated information which you initially provided consent for us to use or where I used the information to perform a contract with you.

Withdraw consent at any time where I am relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, I may not be able to provide certain products or services to you. I will advise you if this is the case at the time you withdraw your consent.

If you wish to exercise any of the rights set out above, please contact us. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, I may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, I could refuse to comply with your request in these circumstances.
